On 5 November 1991, the status of a monument under state law became official for Fort Hahneberg through its entry in the Berlin list of monuments. On 22 July 2009, Fort Hahneberg and parts of its glacis were additionally placed under nature conservation under European law.

Both properties have their justification, but can also be mutually exclusive. Building or altering structures is prohibited in a nature conservation area. An owner is obliged to maintain the monument or protect it from danger.
